LYNN (CBS) – Five people were shot during a July 4th cookout in Lynn. One person died as a result of the Saturday night shooting.

It happened around 10 p.m. on Fayette Street.

Noe Hernandez, a 35-year-old man from Lynn, was taken to Salem Hospital but did not survive.

“I didn’t even realize until I saw the gun in the car shooting,” said a woman who identified herself as Hernandez’s girlfriend.

She said the shooting happened as they were heading home. “But when I came downstairs, that’s when it happened and he just fell on my feet, blood all over my feet.”

Another man was taken by MedFlight to a Boston hospital with life-threatening injuries.

Three others are expected to survive.

Hernandez’s girlfriend said he was trying to protect her. “When I saw him trying to protect me from the bullets, a bullet caught him and that’s when he fell,” she said.

Tyron Brown lives up the street from where the shooting occurred. “My kid is going to try and enjoy the summer and this is what happens. It’s horrible. It’s got to stop.

No arrests have been made.

Those who knew Hernandez said he leaves behind an eight-year-old son.
